Terms and Conditions for CrimeHawk Mobile App

1. Introduction

Welcome to CrimeHawk (a product of Skeep Technologies Pty Ltd), a mobile application that uses quarterly crime reports from the South African Police Service (SAPS) to display crime statistics of all precincts, local municipalities, district municipalities, and provinces. By accessing or using the CrimeHawk app, you agree to be bound by these Terms and Conditions.

2. Acceptance of Terms

By downloading, installing, or using the CrimeHawk app, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the app.

3. Changes to Terms

CrimeHawk reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting. Your continued use of the app after any changes signifies your acceptance of the new terms.

5. Use of the App

5.1 Crime Statistics

5.2 Location Tracking

The app tracks your location to display crime statistics for your current location. By using this feature, you consent to the collection and use of your location data as described in our Privacy Policy.

5.3 Communities Feature

The Communities feature allows users to:

• Communicate with other users in selected precincts.

• Report crimes they witness or experience.

• Use images to show crimes.

By using the Communities feature, you agree to the following:

• Do not post false or misleading information.

• Do not post any content that is illegal, harmful, or violates any laws.

• Respect the privacy and rights of others.

• You are solely responsible for the content you post.

5.4 Subscription and Ad-Free Experience

The CrimeHawk app offers a subscription service that allows users to use the app without any advertisements. By subscribing, you agree to the subscription terms, including any fees and renewal terms.

6. User Accounts

You may need to create an account to use certain features of the app. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

7. User Conduct

You agree not to use the app to:

• Violate any local, state, national, or international law.

• Infringe upon the rights of others.

• Transmit any unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable material.

• Stalk, harass, or harm another individual.

• Collect or store personal data about other users.

8. Reporting Crimes

When reporting crimes through the app, you agree to provide accurate and truthful information. CrimeHawk is not responsible for any actions taken based on reports submitted through the app.

9. Intellectual Property

The app and its original content, features, and functionality are and will remain the exclusive property of CrimeHawk, a product of Skeep Technologies Pty Ltd and its licensors. The app is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CrimeHawk.

10. Subscriptions

10.1 Subscription Services

CrimeHawk offers subscription services that provide an ad-free experience. By subscribing, you agree to pay the subscription fee and any applicable taxes. The fee will be charged at the beginning of the subscription period and each renewal period unless you cancel your subscription.

10.2 Cancellation

You can cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current subscription period.

10.3 Changes to Subscription Fees

CrimeHawk reserves the right to change the subscription fees at any time. We will provide you with reasonable notice of any changes to the fees. Your continued use of the subscription service after the change in fees constitutes your agreement to the new fees.

11. Termination

We may terminate or suspend your access to the app immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.

12. Disclaimer

The app is provided on an "AS IS" and "AS AVAILABLE" basis. CrimeHawk makes no representations or warranties of any kind, express or implied, as to the operation of the app or the information, content, or materials included in the app. You expressly agree that your use of the app is at your sole risk.

13. Limitation of Liability

In no event shall CrimeHawk, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the app; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the app; and (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our app by any third party.

14. Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of the jurisdiction in which CrimeHawk operates, without regard to its conflict of law provisions.
